Terms and Conditions
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all contracts for participation in courses and continuing education concluded between the KUNZ Institute (hereinafter "Provider") and the participant (hereinafter "Participant"). This also includes measures supported under the Accreditation and Admission Regulation for Employment Promotion (AZAV).
1.2 Any deviating, conflicting or supplementary terms and conditions of the Participant shall only become part of the contract if the Provider expressly agrees to them in writing.
2. Conclusion of contract and information for funded measures
2.1 Registration for certified courses takes place via the provider's website, by email, or in writing. By registering, the participant submits a binding offer to conclude a contract.
2.2 The contract is only concluded upon written confirmation from the provider. This confirmation will be sent by email or in writing and will contain all relevant information about the training program required for transparency and traceability.
2.3 The participant will receive all necessary information regarding the course content, learning objectives, duration, and prerequisites, as well as their rights and obligations, in good time before the start of the course. This information constitutes an integral part of the contract.
3. Participation requirements and funding requirements
3.1 Special participation and eligibility requirements may apply to subsidized courses, as determined by the JobCenter or the Employment Agency. Participants are responsible for ensuring that they meet these requirements.
3.2 The provider reserves the right to exclude participants from courses if they do not meet the participation requirements or the funding guidelines. Exclusion is also possible if the funding is revoked by the JobCenter or the Employment Agency.
4. Payment conditions for funded and non-funded measures
4.1 Course fees are specified in the respective course description. For subsidized programs, payment is made directly to the respective funding agency (e.g., JobCenter, Employment Agency). Participants must ensure that they have the training voucher or funding confirmation before the course begins.
4.2 For non-funded courses, the course fee is due upon registration confirmation. Payment is made by bank transfer or using the offered payment methods.
4.3 All prices include VAT unless otherwise stated.
5. Withdrawal, termination and cancellation by the participant
5.1 The participant may withdraw from the contract free of charge up to 14 days before the start of the course. The withdrawal must be made in writing. The date of receipt of the withdrawal notice by the provider is decisive.
5.2 If you withdraw less than 14 days before the start of the course, a cancellation fee of 50% of the course fee will be charged. After the course has begun, the full course fee is due, unless there are compelling reasons for the cancellation beyond the participant's control. A compelling reason would be, for example, the withdrawal of funding from the Job Center or the Employment Agency.
5.3 In the event of a participant discontinuing a funded activity, the provider is obligated to inform the sponsor immediately. Additional documentation may be required, which the participant must provide.
6. Cancellation and changes by the provider
6.1 The provider reserves the right to cancel an event if the minimum number of participants is not reached or for other important reasons. In this case, the participant will be informed immediately, and any payments already made will be fully refunded.
6.2 Changes to the course structure, course content or teaching staff are permitted provided they do not significantly affect the educational objective.
6.3 The provider will inform the participant in a timely manner about changes that are relevant to the funding so that these can be reported to the JobCenter or the Employment Agency.
7. Liability
7.1 The provider is liable for damages caused by intentional or grossly negligent conduct of the provider, its legal representatives or vicarious agents.
7.2 The provider is only liable for simple negligence if essential contractual obligations are breached. In this case, liability is limited to the foreseeable damage typical for the contract.
8. Data protection and information to the cost carrier
8.1 The provider collects and processes the participant’s personal data within the framework of the statutory provisions and in accordance with the data protection declaration of the KUNZ Institute.
8.2 As part of participation in subsidized measures, the provider is entitled and obligated to provide the sponsor (e.g., JobCenter, Employment Agency, Federal Office for Migration and Refugees) with information about the course progress, attendance, performance records, and successful completion of the measure. This data will be transmitted exclusively on the basis of legal provisions and the existing funding agreement.

9. Right of withdrawal
9.1 Participants who are consumers within the meaning of Section 13 of the German Civil Code (BGB) have the right to withdraw their registration within 14 days without giving reasons. The withdrawal period is 14 days from the date of conclusion of the contract.
9.2 To exercise the right of withdrawal, the participant must notify the provider of their decision to withdraw from the contract by means of an unambiguous declaration (e.g., by post or email). To comply with the withdrawal period, it is sufficient that the notification be sent before the expiry of the withdrawal period.
9.3 In the event of an effective cancellation, any payments already made will be refunded immediately.
10. Final provisions
10.1 Amendments and additions to these Terms and Conditions must be made in writing. This also applies to changes to the written form requirement.
10.2 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.
10.3 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes shall be the registered office of the provider, to the extent permitted by law.

Welcome to the KUNZ Institute! These house rules are designed to ensure the smooth running of our daily operations and to create a respectful and safe learning environment for all participants, faculty, and staff. By entering our premises and participating in our courses, you accept the following rules:
1. General behavior
1.1 Respect and fairness: Everyone should feel welcome and respected at the KUNZ Institute. Discrimination, bullying, harassment, verbal or physical violence, and any kind of disrespectful behavior will not be tolerated.
1.2 Punctuality and reliabilityCourse participants are encouraged to arrive punctually at the scheduled course times. Regular and active participation is essential for the success of the courses.
1.3 Order and cleanlinessEveryone is responsible for the cleanliness of the rooms. Please leave your seat and all areas used as you found them.
1.4 Mobile phones and electronic devices: Mobile phones and other electronic devices must be muted during class to avoid disrupting the flow of the lesson. The use of such devices for personal purposes is permitted only during breaks.
2. Use of premises and materials
2.1 premises: The premises of the KUNZ Institute are to be used exclusively for educational purposes. Please ensure that corridors, escape routes, and entrances are not blocked.
2.2 Equipment and learning materialsAll provided materials and technical equipment (e.g., computers, whiteboards, projectors) may only be used for instructional purposes and in accordance with the instructions. Any damage or defects must be reported immediately to the administrative staff.
2.3 Protection of IT systems: The use of IT systems and the Wi-Fi network is permitted only for training and course purposes. Downloading or installing software, accessing unauthorized content, and any misuse are prohibited. Violations may result in disqualification from participation.
3. Breaks, refreshments and smoking ban
3.1 Break regulationsFood and drinks may be consumed in designated break areas. Consumption in classrooms is limited and permitted by arrangement.
3.2 CateringPlease ensure that leftover food and waste are properly disposed of. The communal kitchens and break areas must be left clean after use.
3.3 Smoking ban and non-smoking protectionSmoking is prohibited in all areas of the institute, including directly in front of the entrances. Please use the designated smoking areas outside.
3.4 Alcohol and drugsThe consumption, carrying, and distribution of alcohol or drugs is strictly prohibited. Violations will result in immediate exclusion from the course and may result in legal consequences.
4. Safety and emergency measures
4.1 Fire protection and escape routesAll escape routes and emergency exits must be kept clear at all times. Observe the fire prevention and safety regulations posted throughout the premises. In the event of a fire or emergency, follow the instructions of staff immediately.

7.3 Damages and liability: In the event of damage to property or facilities caused intentionally or through gross negligence, the person responsible is liable and may be required to pay compensation.
8. Entry into force and changes to the house rules
These house rules apply to all persons on the premises of the KUNZ Institute. They take effect on January 1, 2020, and remain valid until further notice.
